BE IT REMEMBERED That the Commissioners’ Court of Comanche County, Texas met in a Regular Meeting on the 22nd day of July, 2019 with the following members present: Judge Stephanie L. Davis, presiding; Gary “Corky” Underwood, Commissioner Precinct #1; Russell Gillette, Commissioner Precinct #2; Sherman Sides, Commissioner Precinct #3. Jimmy Dale Johnson, Commissioner Precinct #4 was not present.
Judge Stephanie L. Davis opened the meeting at 9:05 a.m.
Commissioner Gillette gave the invocation.
Commissioner Underwood made the motion to approve the Minutes of the July 8, 2019 Commissioner Court Regular Meeting as submitted. Commissioner Gillette seconds the motion. All approved. Motion carried.
Commissioner Sides made the motion to approve the Minutes from the July 11, 2019 Special meeting. Commissioner Underwood seconds the motion. All approved. Motion carried.
Public comment was received from Shelby Slawson, candidate for State Representative House District 59. Shelby Slawson spoke briefly to introduce her self and state that she is a candidate State Representative District 59. Ms. Slawson is a resident of Stephenville, Texas.
The City of Comanche and the Economic Development Corporation requested permission to install a marquee message board on the south side of the Courthouse Square. This marquee will replace the marquee currently in place. It is also requested to locate the new LED marquee thirty feet west of the current marquee in order to make it more visible. It will overhang the sidewalk adjacent to Highway 67/377. The marquee currently in place is to be removed from the square and proposed to be relocated to the Community Center. The City of Comanche will own and maintain the marquee. The Chamber of Commerce will manage the content of the marquee. Judge Davis proposed drafting a memorandum of understanding stating location, ownership and maintenance of the new marquee.
Commissioners Underwood and Gillette made the motion and second to approve relocating and installing a new LED marquee the south side of the Courthouse Square. All approved. Motion carried.
Fain McDaniel and Tommy Alford presented the proposed 2019/2020 budget for the Comanche County Historical Commission. Tommy Alford requested a $1000 increase in their budget. This request will be considered during the county budget process.
Hollis McCright and Margaret Dudley met with the Court concerning the public library. Margaret Dudley, Library Board Chairman gave a brief history of the Comanche City County Library. It was stated the library is much more than a library. It serves as the only public internet site in Comanche, several club activities are available such the book club and craft club. The library serves a cooling and heating station for the public.
Hollis McCright presented the proposed budget for the library for 2019/20120. A 4% increase is requested for the library budget. This increase will be addressed during the county budget process.
Judge Davis made the motion to approve the Public Officials Bond for Hollis McCright. Commissioner Sides seconds the motion. All approved. Motion carried.
Judge Davis gave an update on disaster relief regarding the declaration to Governor Abbott concerning flood damages between April 24, 2019 and May 31, 2019. The county sustained four and one-half million dollars in damages during this time. Damage occurred on approximately ninety miles of county roads. There has been damage to two bridges and Comanche ISD had to reroute bus routes because of damages to county roads. Letters were sent to all state and federal officials drawing their attention to the county need and every official has acknowledged our request. We are waiting to see if any action comes about from our request.
Judge Davis informed the court that an application for designation of a reinvestment zone and application for tax abatement had been received from Volleman Dairy Processing Land, L.P. A public notice has been published for the conduct of a public hearing for the designation for the proposed reinvestment zone and to consider the tax abatement on August 1, 2019 at 10:00 a.m. in the County Courtroom. Proper notice has also been given to each taxing entity in the proposed reinvestment zone.
It was reported the Fleming Oak has been trimmed and treated. Three trees have been removed around Old Cora and dirt will be removed from the flower beds around Old Cora and the Fleming Oak and replaced with new material.
Commissioner Johnson, Precinct #4 signed a lease agreement with the City of DeLeon for the use of electricity associated with TXU electric meter #90822787 located at Birdsong Park, 1100 W. Ross, DeLeon. This meter is being required to be in the name of Comanche County rather than the City of DeLeon.
Judge Davis made the motion to acknowledge the lease agreement between the City of DeLeon and Commissioner Johnson. Commissioner Underwood seconds the motion. All approved. Motion carried.
Judge Davis made the motion with a second by Commissioner Sides to acknowledge the Amendment between Comanche County and Gexa Energy, LP putting the meter into the name of Comanche County. All approved. Motion carried.
Judge Davis and Commissioner Gillette made the motion and second to approve contract with Gexa Energy GP, LLC and effective January 23, 2020 the contract will change to MP2 Energy Texas, LLC. All approved. Motion carried.
Commissioners Gillette and Sides made the motion and second to approve the renewal of the Interlocal Agreement between West Central Texas Council of Governments’ Regional 9-1-1 Program and Comanche County. All approved. Motion carried. This is a standard agreement and contains the same verbiage as the one signed in 2017. The State 9-1-1 Commission requires all interlocal agreements be renewed every 2 years.
Judge Davis and Commissioner Sides made the motion and second to approve advertising for bids for material and trucking on FEMA projects. All approved. Motion carried.
Commissioners Underwood and Gillette made the motion and second to approve the Request for Waiver of Local Fund Participation Requirement on Off System Bridges-CR 335, CSJ0923-17-082, NBI#230470AA0321001-CR-4981, CSJ 0923-17-081, NBI#230470AA0284005-CR 4981, CSJ0923-17-086, NBI#230470AA0284004. All approved. Motion carried.
No action was taken on the renewal of contract with Pitney Bowes for the mail machine.
Commissioners Gillette and Sides made the motion and second to approve the following list of members for the Salary Grievance Committee; Monica Maldonado, Martha Williams, Elisa Moreno, Dovie June Kittley, Byron Matthews, Jonathan William Sloan, Malinda M. Spence, Frank Haardt and Lou C. Land. Appointment is pending acceptance by each member. All approved. Motion carried.
Chris Pounds, Chief Sheriff’s Deputy, discussed creating a partnership between the Comanche County Sheriff and the Gustine and Deleon ISD for the placement of a school resource officer at each of these campuses on a part time basis. The salary and benefits for this officer will be shared on the basis of 50% paid by Comanche County and 25% to be paid by Gustine ISD and 25% by DeLeon ISD. The resource officer will be an employee of the Sheriff’s Office. The program will promote good relations between students, the school and law enforcement, promote safety and be a positive influence on the youth.
Commissioners Underwood and Sides made the motion and second to approve entering into a Memorandum of Understanding between Comanche County Sheriff’s Office and the Gustine ISD and DeLeon ISD for a school resource officer for the 2019-2020 school years. All approved. Motion carried.
Commissioners Underwood and Gillette made the motion and second to pre-approve the purchase of equipment for Precinct #3 not to exceed $49,999.99. All approved. Motion carried.
Commissioner Sides is searching for a used truck and road grader possibly from a TXDOT online auction site.
Commissioner Gillette and Sides made the motion and second to approve requesting from the State Comptroller a portion of the unclaimed capital credits received from electric cooperatives back to the counties in the cooperative service area. All approved. Motion carried.
In Emergency Management Operations Tricia Grimshaw reported a time extension from FEMA had been received.
Commissioners Gillette and Sides made the motion and second to enact a Burn Ban for a ninety day period in the unincorporated area of Comanche County beginning today, July 22, 2019. Welding with a spotter and a source of water are excluded from the burn ban as well as cooking in an enclosed barbeque grill. All approved. Motion carried.
Sheriff Lambert reported in Sheriff and Jail Operations that work has started on the new fire panel and should be complete in a couple of weeks. Also under consideration is updating the contracts for housing out of county prisoners.
Officer’s Reports will be considered at a later meeting.
Commissioners Sides and Underwood made the motion and second to approve the Treasurer’s Quarterly Report for the second quarter of 2019. All approved. Motion carried.
Commissioners Gillette and Underwood made the motion and second to approve the Amendments to the budget. All approved. Motion carried.
Commissioners Sides and Gillette made the motion and second to approve the Emergency Amendments to the budget. All approved. Motion carried.
Commissioners Gillette and Underwood made the motion and second to audit accounts due and owing and approve payment thereof in the amount of $219,814.49. All approved. Motion carried.
An Executive Session under Section 551.072 of the Government Code was entered into at 12:38 to deliberate regarding real property located on Grand Street and Houston Street in Comanche. Commissioners Underwood and Gillette made the motion and adjourn the Executive Session and return to Open Session at 1:00 p.m.
No action was taken on the deliberation in Executive Session.
There being no further business to come before the Court, Court was adjourned this the 22nd day of July, 2019 with a motion and second from Commissioners Sides and Gillette. All approved. Motion carried.
