BE IT REMEMBERED That the Commissioners’ Court of Comanche County, Texas met in a Regular Meeting on the 10th day of June, 2019 with the following members present: Judge Stephanie L. Davis, Presiding; Gary “Corky” Underwood, Commissioner Precinct #1; Russell Gillette, Commissioner Precinct #2; Sherman Sides, Commissioner Precinct #3; and Jimmy Dale Johnson, Commissioner Precinct #4.
Judge Stephanie L. Davis opened the meeting at 9:05 a.m.
Commissioner Sides gave the invocation.
Commissioner Sides made the motion to approve the Minutes of the May 28, 2019 Commissioner Court Regular Meeting as presented. Commissioner Gillette seconds the motion. All approved. Motion carried.
Commissioner Johnson made the motion to approve the Minutes of the May 29, 2019 Special meeting as presented. Commissioner Underwood made the second to the motion. All approved. Motion carried.
Commissioner Gillette made the motion to approve the minutes of the May 30, 2019 Special Meeting to approve Payroll as presented. Commissioner Johnson seconds the motion. All approved. Motion carried.
No Public comment was received.
Judge Davis presented an Order for Disbursement of salaries and Routine Office Expense for consideration. Senate Bill 354, 86th Legislative Session authorizes the county payroll officer to pay payroll and authorized routine office expenses from county funds previously budgeted for salaries and authorized office expenses without a special Commissioner’s Court Meeting to approve the payroll and routine office expenses. Commissioner’s Court has been required to hold a special meeting to approve the second payroll each month.
Commissioners Gillette and Sides made the motion and second to approve the Order for Disbursement of Salaries and Routine Office Expenses pursuant to Senate Bill 354, the 86th Legislative Session. The effective date for the legislation is May 31, 2019. All approved. Motion carried.
Sheriff Lambert requested approval of the Deputation of Derek Austin Gunstanson as Deputy Sheriff. Office Gunstanson has been previously employed with Ranger and Bryan Police Departments.
Commissioners Underwood and Johnson made the motion and second to approve the deputation of Derek Austin Gunstanson. All approved. Motion carried.
Commissioners Sides and Gillette made the motion and second to approve the purchase of a 2011 Freightliner Belly Dump Truck VIN #17UJGEDV4BSAX7315, from Penske Truck Leasing Co., L.P. for the purchase price of $33,507.00. All approved. Motion carried.
An application for a new county road was filed by eight land owners whose property joins Apache Drive at the South City Limits of DeLeon. The following land owners, Lola Carr, Terry W. Brown, Gaylon & Debbie Fleming, Jerlene Setzler, Betty Rice, Dalia Keeter, Toney Prather and Nancy Johnson, are requesting the county adopt a portion of Apache Drive for maintenance. Proper notices have been posted at the Courthouse and on Apache Drive beginning May 17, 2019.
Commissioner Underwood made the motion to adopt a section of Apache Drive containing 1060 feet beginning at the south City Limits of DeLeon at GPS Latitude 32.100900 N., Longitude 98.544100 W. and extend south ending at Latitude 32.098021 N., Longitude 98.545130 W., at a dead end. Commissioner Sides made the second. All approved. Motion carried.
Assessment, care and maintenance of the Fleming Oak were discussed. Two assessments of the condition of the Fleming Oak, one by the Texas Forrest Service and one by Duncan Brooks, a certified Arborist specializing in oak wilt have been made. The Fleming Oak does not have oak wilt. Duncan Brooks recommended removal of two elm trees near Old Cora, removing all competing landscape shrubs except the Knockout Roses, all soil levels around Old Cora and the Fleming Oak will be removed to a depth of 3 inches and soil aeration to improve water penetration and increase oxygen in the soil. Five organic soil amendments need to be added to the 8 beds around Cora and the Fleming Oak. Brooks also recommended feeding of trees with an organic solution plus insecticide to control insects. Brooks recommended pruning of the Fleming Oak to include light thinning, raising & removal of deadwood to a minimum size of 2 inches. All work will be done on a Saturday and when the temperature is above 90 degrees. Beatles that case Oak wilt are not active when the temperature is above 90 degrees or below 60 degrees. Clint Tunnel, Texas Rural Living proposed to inspect and install sub surface drip irrigation in each flower bed, plant low maintenance drought resistant plants on the west side of Old Cora and install decomposed granite fines in each flowerbed.
Commissioners Gillette and Underwood made the motion and second to accept the proposals from Duncan Brooks and Texas Rural Living for the assessment and care of the Fleming Oak at Old Cora on the Courthouse Square. All approved. Motion carried.
Restricting certain fireworks in the unincorporated area of the county for the Fourth of July period can not be implemented because the Texas Forrest Service does not have Comanche County under a drought condition.
Sheriff Lambert received notice that the most recent inspection of the Comanche County Jail on May 29, 2019 by the Texas Commission on Jail Standards demonstrated that the facility is in compliance with Texas Minimum Jail Standards.
Tricia Grimshaw, Emergency Management Coordinator distributed precinct lists of roads with culverts and bridges. These lists will satisfy TXDOT requirement for in-kind work.
It was recommended the Burn Ban remain off at this time. However, it is recommended burning be done with humidity of 50 % or above, winds 10 miles an hour or lower, method of fire suppression available, no night time burning, trash burning in a covered barrel and notify Dispatch of your burn prior to starting so that unnecessary emergency response is not needed.
Sheriff Lambert was present but had nothing additional to report in Sheriff and Jail operations.

Commissioners Sides and Gillette made the motion and second to approve the Treasurer’s Monthly Report for the month of May, 2019. All approved. Motion carried.
Commissioners Johnson and Sides made the motion and second to approve Budget Amendments as presented for approval. All approved. Motion carried.
Commissioners Underwood and Gillette made the motion and second to approve the Emergency Amendments to the Budget. All approved. Motion carried.
Commissioner Underwood and Gillette made the motion and second to audit accounts due and owing and approve payment thereof in the amount of $229,287.25. All approved. Motion carried.
There being no further business to come before the Court, Court was adjourned this the 10th day of June, 2019 with a motion and second by Commissioner Sides and Underwood. All approved. Motion carried.
