COMMISSIONERS’ COURT MEETING

August 26, 2019

BE IT REMEMBERED That the Commissioners’ Court of Comanche County, Texas met in a Regular Meeting on the 26th day of August, 2019 with the following members present: Judge Stephanie L. Davis, presiding; Gary “Corky” Underwood, Commissioner Precinct #1; Russell Gillette, Commissioner Precinct #2; Sherman Sides, Commissioner Precinct #3; and Jimmy Dale Johnson, Commissioner Precinct #4.

Judge Stephanie L. Davis opened the meeting at 9:03 a.m.

Commissioner Underwood gave the invocation.

Commissioner Gillette made the motion to approve the Minutes of the August 12, 2019 Commissioner Court Regular Meeting. Commissioner Johnson seconds the motion. All approved. Motion carried.

Commissioner Sides made the motion to approve the Minutes from the August 19, 2019 Special meeting. Commissioner Underwood seconds the motion. All approved. Motion carried.

No public comment was received.

Tom Tolson, Trinity Tek, Inc. addressed the court concerning cyber security for the County. Tolson recommended an assessment of the different offices be made and then make recommendation for ways to improve cyber security.

Judge Davis made the motion to authorize Tom Tolson to perform a county cyber security assessment of the Courthouse and related offices. Commissioner Gillette seconds the motion. All approved. Motion carried.

The Public Hearing on the proposed Archive Plan for 2020 will be conducted on September 9, 2019. No discussion or action was taken.

Commissioner Johnson submitted a request for a pipeline installation from Lone Star NGL for installation of pipeline in County Right of Way on County Roads 479, 486, 482, 495, 492, 456 and 454 in Precinct #4. No action was taken on this agenda item. This will be reset for the September 9, 2019 Commissioner Court meeting.

Grace Everhart discussed a correction to the contract with Government Credentialing, Experian Information Solutions Division. Experian agreed to discount the implementation fee from $4500.00 to $300.00. This is a one-time discount. The fee for searches is $.22 per transaction with a minimum of $50.00 monthly. This program is used to locate persons who are missing from the tax roll.

Commissioner Johnson and Sides made the motion and second to approve the correction to the Experian Contract granting a one-time discount of the implementation fee. The fee is reduced from $4500.00 to $300.00. All approved. Motion carried.

Commissioner Johnson and Underwood made the motion and second to approve the Interlocal Agreement between Hamilton Independent School District and Comanche County for election services to be performed during the Hamilton ISD Bond Election to be held on November 5, 2019. All approved. Motion carried.

Commissioners Sides and Johnson made the motion and second to approve the Joint Election Agreement between Comanche County and Hamilton ISD for the November 5, 2019 Election. All approved. Motion carried. This agreement permits sharing of polling locations, voting equipment, joint ballot and workers during the Constitutional Amendment Election and the Hamilton ISD Bond election to be held November 5, 2019.

Commissioners Sides and Underwood made the motion and second to acknowledge the Order Setting Public Hearing to be held on September 10, 2019 at 10:00 a.m. to review and set the Annual Budget for the County Auditor, Assistant Auditor and the proposed compensation for the 220th Judicial District Court Reporter. The hearing will be held in the 220th Judicial District Courtroom. All approved Motion carried.

Patsy Phifer, County Treasurer informed the Court of receipt of the Surplus Distribution from 2018 in the amount of $35,456 from the Texas Association of Counties Health and Employee Benefit Pool. This distribution is based on a review of the financial results, estimated Pool expense for the coming year, and a determination whether there is a surplus of revenue over claims, fixed expenses and needed reserves.

An Interlocal Agreement between Lubbock County, Texas acting thru the Regional Public Defender for Capital Cases and Comanche County was discussed. This program will provide court appointed counsel for individuals charged with the offense of capital murder in participating counties and who cannot afford to hire their own attorney. The program is funded with cost sharing thru the Texas Indigent Defense Commission consisting of Grant Funds and funds from participating counties. The fee for Comanche County to participate would be $ 5760.00 for FY 2020 and $5760 for FY2021. County participation fee is based on population. No action was taken on this agenda item. This agreement will be considered at the September 9, 2019 Commissioner Court meeting.

The County portion of the funding for the School Resource Office for the DeLeon ISD and Gustine ISD will be funded from the salary of Office Administrator position under the Sheriff’s Office until October 1, 2019. Beginning October 1, 2019 the County portion of the funding will be from the School Resource Officer position.

Commissioners Underwood and Sides made the motion and second to acknowledge moving the School Resource Officer salary funding from Office administrator to School Resource Officer position beginning October 1, 2019. All approved. Motion carried.

Judge Davis presented information related to the Rules of Procedure, Conduct and Decorum at the Meetings of Commissioner’s Court. On June 10, 2019 Governor Greg Abbot signed House Bill 2840 imposing new stipulations for meetings of Commissioner’s Court, which go into effect September 1, 2019. The Statute specifically states “A governmental body shall allow each member of the public who desires to address the body regarding an item on an agenda of the body to address the body regarding the item at the meeting before or during the body’s consideration of the Item” In addition, the statute states: “A governmental body may not prohibit public criticism of the governmental body, including criticism of any act, omission, policy, procedure, program or service. This subsection does not apply to public criticism that is otherwise prohibited by law.”

Commissioners Gillette and Underwood made the motion and second to approve amending the Rules of Procedure, Conduct and Decorum from the Meetings of the Comanche County Commissioner’s Court as approved on February 25, 2019 to reflect the provisions as stated in House Bill 2840 and stated above. This replaces the original rules filed on February 25, 2019. All approved. Motion carried.

In Emergency Management Operations Judge Davis, Tricia Grimshaw, Mary Boyd and all who helped with the water issue that the City of Comanche experienced last week were commended for their efforts.

A Burn Ban was enacted for a ninety day period in the unincorporated area of Comanche County which began July 22, 2019 and is still in effect. Welding with a spotter and a source of water are excluded from the burn ban as well as cooking in an enclosed barbeque grill. It is recommended calling Dispatch to inform them of your burn in order to avoid unnecessary responses from the fire department. Wind should be 10 miles an hour or less and humidity of 50% or above.

In Sheriff and Jail Operations it was reported all inmates are back in the Comanche County Jail. Inmates were moved to Erath and Mills County during the water crisis experienced last week. Officer Pounds commented this was the first time a mass evacuation of the jail had been conducted and it went very smoothly. Thanks go to Comanche ISD for the use of school buses to transport inmates. During the time the inmates were out of the jail the time was used to make some repairs.

Commissioners Sides and Underwood made the motion and second to approve Officer’s Reports as presented. All approved. Motion carried.

Commissioners Gillette and Johnson made the motion and second to approve the Amendments to the budget. All approved. Motion carried.

Commissioners Johnson and Sides made the motion and second to approve the Emergency Amendments to the budget. All approved. Motion carried.

Commissioners Gillette and Sides made the motion and second to audit accounts due and owing and approve payment thereof in the amount of $432,103.26. All approved. Motion carried.

A Budget Workshop was conducted.

There being no further business to come before the Court, Court was adjourned this the 26th day of August, 2019 with the motion of Commissioner Sides and the second by Commissioner Johnson. All approved. Motion carried.
